Terms and conditions

GLOSSARY

Mon Petit Bébé online store – online store available at http://www.monpetitbebe.pl offering merchandise via the Internet;

Warehouse – place where Customers’ orders are completed;

Business days – weekdays from Monday to Friday with the exception of public holidays;

Order completion time – time during which Mon Petit Bébé online store will prepare the order and send it off to the delivery address provided;

Online store database – database contacting all information about the transactions and merchandise carried our in the Mon Petit Bébé online store. The database also contains all Customer’s personal data, which have been provided for the order completion purposes;

Customer – a physical person or a legal entity placing an order in the online store. Customer can choose to register or place and order without prior registration in the Mon Petit Bébé online store;

Customer Account – database containing Clinet’s personal data used for the order completion purposes, order history as well as Customer’s preferences as to particular functionalities of the Mon Petit Bébé online store;

Bank transfer –payment, carried out by the Customer via the personal bank account;

Electronic payment – payment carried out by the Customer via the personal bank account or the online electronic payment service Platinosci.pl;

Shopping Basket – Part of the Mon Petit Bébé online store, through which the Customer specifies the number of items, delivery address, delivery and payment form;

Product site (eShop) – website within the Mon Petit Bébé online store, which presents all the information about a particular product;

Party completing the payment – a party external to Mon Petit Bébé online store, acting as an intermediary when completing a payment via bank transfer, electronic payment or credit card;
 

§ 1. Types and scope of services offered at the Mon Petit Bébé Online Store

1. Mon Petit Bébé Online Store offers a variety of merchandise via its internet based online store.
2. Mon Petit Bébé Online Store carries out sale of its products according to the terms and conditions stated in this document.
3. Mon Petit Bébé Online Store acts in accordance to the privacy policy and guarantees full personal data protection as well as acts in the highest interest of the Customer.
4. Mon Petit Bébé Online Store offers a Blog for its Customers and Guests visiting the website. It contains posts referring to the general subject of baby care.
 

§ 2. Order completion conditions

1. Customer can place orders in the Mon Petit Bébé online store 24 (twenty four) hours a day via the Internet website http://www.monpetitbebe.pl.
2. Customer can place orders as a Registered Customer via the existing Customer Account in the Mon Petit Bébé online store or as an Unregistered Customer.
3. In the event of placing an order by an Unregistered Customer or from a newly created Customer Account, Customer receives an email requiring an order placement confirmation, followed by which the Store commences the order completion procedure.
4. The Customer can place an order subject to prior registration and logging in, choosing a given item and its parameters, size, color and any other necessary specifications. Following adding the product to the shopping basket, the Customer chooses the preferred payment and delivery form. It is also possible to indicate a delivery address different to the one provided while registering.
5. By placing an order, Customer agrees to a sale terms and conditions of the Mon Petit Bébé online store.
6. During the order placement procedure (Shopping Basket) the Customer specifies:
    a) Product ordered,
    b) Delivery address if different to the one originally provided when registering for Customer Account,
    c) Delivery form,
    d) Payment form.
7. Immediately following an order placement, the Customer receives an email confirmation specifying the order details.
8. The delivery of the order is carried out only when the product is available in the Warehouse. In the event of the product being out of stock, the system prevents the Customer from ordering the product.
9. In the unusual cases, Mon Petit Bébé online store can choose to divide an order or cancel it completely.
10. Should an order be divided due to reasons depending on Mon Petit Bébé, the Customer only pays one delivery charge, while the remaining deliveries within the order are covered by the Mon Petit Bébé online store.
11. The order is delivered to the delivery address specified by the Customer during the order placement procedure.
12. Delivery charge is covered by the Customer. In the event when the order exceeds 250PLN in value, delivery charge is covered by the Mon Petit Bébé online store. The delivery charge depends on the delivery charges imposed by the courier operator. The delivery charge will be specified in the summery of the order in the Shopping Basket.
13. In the event of placing a larger order, Mon Petit Bébé online store can choose to divide the order into several parts. In such case, the Customer pays only one delivery charge, while the remaining deliveries within the order are covered by the Mon Petit Bébé online store.
14. Mon Petit Bébe online store is not responsible for the undelivered packages or delays in delivery nor for failing to complete an order due to the incorrect delivery address provided by the Customer.
 

§ 3. Product prices

1. Mon Petit Bébé Online Store posts information about its current product offer on the Internet website http://monpetitbebe.pl and offers merchandise which are included in the Mon Petit Bébé online store.
2. Product prices are indicated next to each product offered:
    a) prices include VAT and are indicated in PLN;
    b) prices do not include delivery charges.
3. Price indicated at the end of the ordering process within the Mon Petit Bébé online store is binding and final. The final price is indicated in the Order Summary tab during the checkout procedure in the Shopping basket.
4. Mon Petit Bébé online store has the discretion to alter the prices at any time as well as to carry out and cancel any promotion activity. The discretion in question does not affect orders placed prior to the introduction of any price changes.
5. Promotions launched by the Mon Petit Bébé online store cannot be joined unless the terms and conditions state otherwise.
6. Each order from the Mon Petit Bébé online store is supplied with a proof of purchase: receipt or an invoice (if requested). Should the Customer wish to receive an invoice, it is advisable to register “as a company” and provide the supplementary information.
 

§ 4. Order changes

1. The Customer has the right to change the order up to the point when the order is shipped out to the delivery address provided.
2. Order changes are possible via the Customer Service, or by using the contact form available at the Mon Petit Bébé Internet website, or by email: info@monpetitbebe.pl or by phone.
3. Order changes can be applied to the whole order placed or its part. They can also involve delivery address changes or changes to the requested invoice. In case of cancelation of a prepaid order, a refund of monies will take place up to 14 (fourteen) business days from the date of the order placement. Mon Petit Bébé customer service will contact the Customer to agree upon the acceptable repayment form.
 

§ 5. Payment forms, commencement of order completion process

1. Payments for merchandise purchased and deliverable in Poland can be:
    a) by cash in case of the delivery form being COD (Cash on Delivery) - the order completion process will commence following the confirmation of the order placement carried out by the Customer;
   b) electronic payment, bank transfer or credit card - the order completion process will commence following the receipt of payment confirmation sent to Mon Petit Bébé online store by an external party in charge of payment process.
2. Payments for merchandise purchased and deliverable outside Poland can be processed via an electronic payment, bank transfer or credit card. The order completion process will commence following the receipt of payment confirmation sent to Mon Petit Bébé online store by an external party in charge of payment process.
3. The Customer is eligible to take advantage of promotions, rebates and discounts issued by the Mon Petit Bébé online store, subject to their terms and conditions. The terms and conditions of each promotion will be published at the Mon Petit Bébé internet website.
4. Mon Petit Bébé online store has the right to amend the delivery and payment forms available.
 

§ 6. Order completion time

1. Mon Petit Bébé online store indicates the time (in business days) during which the Customer’s order will be completed and sent out. This time takes into account time required for order assembly and preparation for shipment.
2. Next to each product there is information about its availability.
3. Orders deliverable in Poland and abroad are delivered via courier service to the delivery address provided during the checkout procedure.
4. Mon Petit Bébé online store is not responsible for the extended delivery times due to circumstances of the operating party in charge.
 

§ 7. Complaint policy

1. All merchandise available in the Mon Petit Bébé online store comes from a legal source and holds a producer’s guarantee.
2. The Customer has the right to file a complaint regarding a purchased product in case of:
    a) Fabrication defect;
    b) Mechanical fault occurred during the transportation process;
    c) Discrepancy as to the content of the order.
3) In such an event, the Customer shall send the merchandise back to the mailing address of the Mon Petit Bébé online store. It is required to provide the original receipt as well as the description of the product’s fault. Mon Petit Bébé online store will not accept packages payable to receiver (COD)
4) Mon Petit Bébé online store has 14 (fourteen) business days counted from the receipt of the return to analyze the fault and inform the Customer about the result of the investigation.
5) In the event of complaint acceptance, the Customer will be offered a choice of a product exchange or if not possible (due to product discontinuance) an exchange for alternative product equal in value. The shipping and handling costs covered by Customer will be reimbursed immediately after acceptance of the complaint.
6) Mon Petit Bébé online store cannot accept any complaints due to differences between the actual product and the pictures provided via the Mon Petit Bébé internet web, which can be due to different product parameters, Customer’s computer screen.
7) The Customer has the right to return the product during a period of 2 years from the day of purchase of purchase subject to informing the store about such intent within the period of two months from the moment of spotting the discrepancy as to the content of the order.

§ 8. Returns

1. Customer has the right to cancel the order, which has not yet been completed by contacting the Mon Petit Bébé customer service.
2. Customer has the right to return each product purchased from the Mon Petit Bébé online store without giving any reason within 10 business days from the time of its delivery. The Customer has the right to return the content of the whole order or is part.
3. The return of the product is only possible if it does not have any signs of use and is not damaged in any way. The returned product has to be complete.
4. In case of return of the delivered product, Mon Petit Bébé online store will reimburse the Customer within the period of 14 (fourteen) days counted from the delivery of the product if the payment was upfront. The payment is done to the bank account indicated by the Customer.
5. The returned products should be sent to the Mon Petit Bébé mailing address. Mon Petit Bébé does not accept packages payable to the recipient (COD).
6. All payments are carried out in PLN. In the event of the payment has been originally carried out in a foreign currency, the reimbursement will be carried out in PLN and then recalculated into the foreign currency as per the average exchange rate of the National Bank of Poland from the day of the transaction.

 

§ 9. Newsletter of the Mon Petit Bébé online store

1. Customer can to sign up to receive the Newsletter of the Mon Petit Bébé online store.
2. The newsletter is only sent out to users, who previously agreed to receive it. Customer has to agree to receive the newsletter sent out by Mon Petit Bébé online store electronically, as well as has to agree to the processing of his personal data necessary for its delivery.
3. At any time the Customer has the right to discontinue receiving the Newsletter.
 

 § 10. Promotions, Rebates and Discounts

1. Mon Petit Bébé online store can organize promotions and issue rebates and discounts for the merchandise offered.
2. All promotion activities are described on the Internet website of Mon Petit Bébé online store as the promotions occur.
3. The terms and conditions of promotions are stated on the internet website of Mon Petit Bébé online store.
4. The individual promotions, rebates and discounts exclude a possibility of combining them together unless stated otherwise.

§ 11. Personal Data

1. By placing an order at the Mon Petit Bébé online store a Customer agrees for the personal data to be stored in the data base of the Mon Peit Bébé online store and processed for the order completion purposes. The Customer is obliged to provide the personal data and agree to its processing. The Customer takes full responsibility of the consequences of providing incorrect or untrue person data.
2. By registering in the Mon Petti Bébé online store the Customer agrees for its personal data to be processed for the order completion purposes. A withdrawal of such agreement prevents the finalization of the order completion process. The Customer takes full responsibility of the consequences of providing incorrect or untrue person data.
3. Personal data are protected according to the Act dated 29.08.1997 “The personal data protection” (Dz.U. Nr 133 poz. 883) in the way that no third party has any access to it. Personal data preserved in the database are not passed nor sold to parties not involved in the order completion process.
4. The Customer has the right to review, modify and suppress his personal data.
 

§ 12. Blog

1. For its Customers and Guest, Mon Petit Bébé offers a Blog, on which one can post news posts referring to the general subject of baby care.
2. Updates posted onto the blog can be commented and the Customers can make their own comments.
3. Mon Petit Bébé online store is the Administrator of the Blog.
4. Customers as well as Guests are forbidden from posting unlawful or insulating comments.
5. It is forbidden to post vulgar comments. Such action allows the Administrator to suppress the entire comment.
6. Posts containing forbidden content will be suppressed by the Administrator immediately following such occurrence.
7. Mon Petit Bébé online store is not obliged to answer all the comments and questions posted.
8. Discussions under the posts shall be carried out in the mannerly fashion.
9. It is forbidden to post any advertisements designated for the Users and Guests of the Blog. Such advertisements will be removed by Administrator.
10. It is forbidden to post photos. Such actions will be removed by the administrator.
11. In the event when actions of a newly joined user suggest he/she did no read or partially read the terms and conditions without full understanding, or indeed understood them but does not comply to the rules, the Administrator (without notice) has the right to block the User.
12. The Administrator has the right to remove posts of different topics to the general subject of the Blog.
13. It is forbidden to post comments about the orthographical or grammatical errors.
14. Users acting notoriously in breach of the terms and conditions can be banned permanently from using the Blog. A banned User will not be able to access the Blog. The Administrator has full discretion as to banning a User. Upon receipt of a ban, the user has 3 days to justify the actions and explain the reasoning behind them. Following that period the ban becomes final and is not subject to negotiations.
15. The Administrator has the right to change the terms and conditions.
16. The Administrator is not responsible for the content of the posts made to the Blog.
17. The Administrator monitors the Blog and welcomes all the comments about it to the email address: info@monpetitbebe.pl
18. The administrator has the right to remove a user without further reasoning.
 

§ 13. Final provisions

1. Sales contract is carried out between the Customer and the company Mon Petit Bébé Jan i Pawel Modrzejewscy s.c.
2. Fixation and protection of the important provision in the contact takes place once the once the order is placed at the Mon Petit Bébe online store. Order confirmation is sent by email to the email address provided by the Customer.
3. The merchandise offered by the Mon Petit Bébe online store does not constitute the offer according to the Law of Civil Code. Due to the possibility of errors during the actualization (e.g. prices, configuration, etc.) – potential discrepancies will be corrected during the order completion process.
4. Mon Petit Bébé online store is not responsible for the undelivered correspondence due to the external Administrator’s barriers, firewalls or any other software installed on the Customer’s computer preventing the receipt of the correspondence from Mon Petit Bébe online store.
5. The differences between the visualization of the Product at the Mon Petit Bébé online store resulting from the individual settings of the Customer’s computer (color, proportions, etc.) do not stand the basis for filing a complaint about the merchandise purchased at the Mon Petit Bébé online store.
6. In all other cases undefined by this document, the applicable law is the general terms of Polish law as well as Civil Code.
7. All names of the merchandise offered by the Mon Petit Bébé online store are used for identification purposes and can be protected or registered.
 

§ 14. Terms and conditions of the Mon Petit Bébé online store

1. The terms and conditions stated in this document are valid from 1 January 2010.
2. Mon Petit Bébé online store has full discretion as to any changes in the terms and conditions. All changes are applicable from the date of when posted at the Mon Petit Bébé website: http://www.monpetitbebe.pl. The orders placed prior to the introduction of the changes in question will be completed according to the original terms and conditions.
